HOW WE MAY RESPOND TO DMCA COPYRIGHT NOTICE?

We reserve the right to decide whether we remove or restrict access to allegedly infringing material. If we decide to remove or restrict access to material in response to a DMCA copyright notice, we will make our best attempts to directly contact the person who submitted the aforementioned copyright notice.

HOW TO SUBMIT A DMCA COUNTER NOTICE?

If We and/or any group/individual believe our/their material was removed and/or restricted as a result of an erroneous copyright notice, We/they have the right to submit a DMCA counter notice which includes all of the listed information:

Our/their name, address, telephone number and physical and/or electronic signature;

Clear identification of the content and is location before its removal and/or restriction;

A written statement that, under the penalty of perjury, states the removed and/or restricted material was done so due to an erroneous copyright notice; and

Consent to the jurisdiction of federal district court for the provided address or, if said address is located outside of the United States, then you consent to the jurisdiction of the judicial district in which Palcon Enterprises LLC is headquartered in Alexandria, VA, and that you will accept service of process form the party and/or parties which provided notification of alleged infringement.

Such written DMCA counter notice will be sent to the Designated Copyright Agent. Their contact information is listed below this notice.

WHAT HAPPENS AFTER YOU SUBMIT A DMCA COUNTER NOTICE?

Palcon Enterprises LLC will do their best to contact and forward the information within the counter notice to the party and/or parties who submitted the original DMCA copyright notice. If the offending parties wish to take further action, that is their right. However, if We do not receive notice within 10 business days that the original offended party and/or parties is seeking court action to prevent future infringement of the subject material at issue, We reserve the right to replace and/or cease restricting access to the alleged offending material.

HOW DO YOU HANDLE USERS WHO VIOLATE COPYRIGHT LAWS? HOW DO YOU HANDLE REPEAT INFRINGERS?

It is the policy of Palcon Enterprises LLC and Fresh Kpop to remove user generated content and/or material that allegedly violates copyrights. If you wish to submit a DMCA copyright notice about the content generated by a user of Fresh Kpop please include the displayed name and clear identification of the allegedly offending content.

Upon receiving your notice, Palcon Enterprises LLC will make a judgment as to whether to delete and/or restrict access to the allegedly offending content. If you disagree with the decision of Palcon Enterprises LLC you have the right to submit an appeal to Palcon Enterprises LLC through a written notice including your original DMCA copyright notice submission and an explanation for your appeal.

Upon receiving your appeal, Palcon Enterprises LLC will revisit their original judgment on the alleged offending material and decide to remove and/or restrict the alleged offending material or not. If you disagree with the appeal decision of Palcon Enterprises LLC you have the right to pursue court action to prevent the further usage of your copyright material.

If Palcon Enterprises LLC receives 3 copyright notices which result in a copyright violation about a user of any digital space created and/or managed by Palcon Enterprises LLC, Palcon Enterprises LLC will terminate the account of the offending party and/or parties. Additionally, Palcon Enterprises LLC reserve the right to terminate accounts of users who are only responsible for a single copyright violation if the circumstances warrant it. Finally, this detailed process should not be construed as to mean that Palcon Enterprises LLC is limited in Our ability to pursue any other legal remedies We have access to address suspected infringement.

Violation Procedure

In the event that your comment violates our policy it will be removed.

If your user profile is reported for violating our policy multiple times it will be subject to the following:

1st Violation = Comment removed and a corrective email is sent to the commenter.

2nd Violation = Comment removed, a corrective email is sent to the commenter, and the commenter is banned for a week.

3rd Violation = Comment removed, a corrective email is sent to the commenter, and the commenter is permanently banned.

Special Note: The Palcon Enterprises LLC team reserves the right to permanently ban a user after one comment/anytime if we feel the comment/user is severely violating our site’s policies.
